This Privacy Policy (“Policy”) explains how Kyotosumi LLC, together with its officers, employees, agents, and representatives (collectively “Kyotosumi,” “we,” “us,” or “our”), collects and uses your personal information on our Website and elsewhere. We may amend this Policy from time to time, and changes will be posted to our Website. This Policy is governed by our Terms of Use, and capitalized terms not defined here carry the meanings given in the Terms of Use.

For certain Products, we may provide supplemental privacy notices at the time we collect personal information; those notices govern how we process personal information in the context of the specific Product.

Who You Are

We collect personal information from several types of people:

  • Our customers and Website visitors.
  • Vendors and third parties who perform services for us.
  • Personnel who work for us.

Information We Collect and Its Sources

“Personal information” means any information relating to an identified or identifiable individual. To provide you with our Products, including access to our Website, we need to collect and process some of your personal information. What we collect, and why, depends on the type of information. The categories below, alone or in combination, may constitute personal information:

  • Personal and contact information, such as name, postal address, phone number, email address, birthday month and day, photographs, gender, and fit or body measurement details for you or anyone whose information you provide.

  • User Content, such as reviews, posts, or other material you choose to publish through the Website that may directly or indirectly identify you.
  • Usage and electronic information, such as how you use and interact with the Website, page visit history, IP address, cookie identifiers, device type and hardware identifiers, mobile identifiers, browser information, IP-based device geolocation, and analytics about your use of the Website.
  • Marketing information, such as your communication preferences and how you engage with our communications.
  • Social media information, such as a social media URL, alias, photographs, or other profile data you voluntarily provide.
  • Payment and transaction information, such as billing address, general payment type, the last four digits of a card if you opt to save it for convenience, cart contents, and your purchase history.
  • Mobile information, such as phone number, wireless carrier, and the date, time, and content of text messages you send us.
  • Other information not specifically listed here, which we will use in accordance with this Policy or as otherwise disclosed at the time of collection.

A note on credit card information. Except as described above, we do not collect, receive, or store your full credit card information. Our payment vendors process card details to complete your purchases, and your choices regarding that information are described in the Your Choices section below.

A note on fit and measurement details. We collect fit information to help provide properly sized Products, and you may optionally add fit details to your profile. We may receive photographs if you post a photo review, email us a photo, grant a request to use your photo from a third-party platform, or a third party shares a photo with your permission. We will never use your photograph without your express permission or a third party’s confirmation of that permission, and you may withdraw consent at any time by emailing hello@kyotosumi.com or by adjusting your settings with the relevant third party.

Information We Receive from Third Parties

In addition to information you give us directly or that comes from analytics services, we may receive personal information from third parties such as social media platforms, marketing companies, and third-party cookies. We generally use this information to personalize your shopping experience and to tell you about our Products.

Recruiting Information

If you apply to work with or for us through the Website or otherwise contact us about opportunities, we may collect your contact information, resume details such as qualifications and employment or education history, reference names and contact details, and any social media information you choose to share.

Referrals

If you refer friends or otherwise provide us with someone else’s personal information, you may do so only with that person’s permission, and by providing the information you represent and warrant that you have the authority to permit us and our service providers to use it in accordance with this Policy.

How and Why We Use Your Personal Information

To complete transactions. We use your personal information to process purchases, returns, and exchanges, ship items, provide support, help you and others select Products, and administer the Heritage Club, our loyalty program.

To operate the Website. We use your personal information to:

  • provide, operate, and improve the Website, including publishing User Content in accordance with the Terms of Use;
  • communicate with you about the Website, including announcements, updates, security alerts, and administrative messages;
  • understand your needs and interests and personalize your experience;

To send marketing and promotional communications. As permitted by law, we may send marketing communications through channels such as email and online advertising, which may include recommendations based on items you viewed. You can opt out as described in the Your Choices section below.

For research and development. We may analyze use of the Website to improve it, develop new offerings, and plan for the business.

To process applications. We may use your personal information to review and respond to applications or opportunity inquiries.

For compliance, fraud prevention, and safety. With your consent. In some cases we will specifically ask for your consent to collect, use, or share your personal information.

To create de-identified data. We may create anonymous, aggregated, or de-identified data from personal information by removing identifying details, and we may use and share that data for lawful business purposes.

For training and other business purposes. We may use information to train our personnel and, subject to this Policy, for other legitimate purposes permitted by applicable law.

Information We Share

Except as described in this Policy, we will not provide third parties access to your personal information for any unauthorized purpose.

Service providers. We work with third-party vendors that help us operate and improve the Website, deliver orders, and provide advertising, email, hosting, payment processing, research, marketing, customer support, analytics, and security services. These vendors have limited access to your information, may use it only to perform tasks on our behalf, and are contractually required to implement appropriate technical and organizational safeguards. Because of how “sale” is defined under certain laws, sharing with some advertising-related vendors may be deemed a sale; see Your Regional Privacy Rights below. Demographic information shared with vendors is aggregated and de-personalized first.

Business transfers. Your information remains subject to this Policy through any business transition, though we may transfer it to a successor entity in connection with an acquisition or corporate reorganization.

Compliance, fraud prevention, and safety. We may disclose your information where we believe in good faith that disclosure is required by law or reasonably necessary to comply with legal process, enforce our Terms of Use, respond to legal claims, or protect the rights, property, or safety of Kyotosumi, our users, or the public.

Corporate affiliates. We may share personal information with entities under common ownership or control with Kyotosumi for purposes consistent with this Policy.

With your consent, with other users, and for other purposes. We may share personal information with your consent or at your direction, as part of Website features you elect to use, and for other legitimate purposes permitted by applicable law.

Your Choices

Choosing not to share. You may decline to provide personal information, but if you do (or ask us to delete it), we may not be able to provide our Products. Required information will be designated at the time of collection.

Updating your information. Information stored in your account profile can be changed or corrected through the account section of the Website or by contacting us as set forth below. Only your name, email address, and password are required for an account.

Opting out of marketing. You may opt out of marketing emails and texts by following the unsubscribe instructions in any message or by contacting us. If you opt out, you may still receive service-related and other non-marketing communications.

Cookies, browser storage, and targeted advertising. We may allow service providers and other third parties to use cookies and similar technologies to track browsing activity over time and across websites. Partners that collect information about your activity may participate in programs offering choices about the use of browsing behavior for targeted advertising.

Credit card information. Our payment vendors may collect and save your card information to ease future purchases. We do not collect, use, or store your full card information. You may be able to change or remove saved card information through those vendors directly.

Personal Information of Children and Minors

The Website is a general audience website, is not directed to individuals under 18 or under the age of majority in their jurisdiction (“Minors”), and Minors are not permitted to use it. We do not intentionally collect personal information from Minors, and if we learn we have done so without parental or guardian consent, we will delete it and terminate any applicable accounts. Security, Storage, and Retention

How We Protect Your Information

We implement technical and organizational measures designed to secure personal information, taking into account the risks presented by processing it, including accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. Security risk is inherent in all internet technologies, however, and we cannot guarantee the security of your personal information.

Where We Are Located

We are located in the United States and store your information in the United States. Third parties with whom we share information may store it in other countries. By using our Website or providing us information, you agree to the transfer and storage of your data in the United States or other countries.

Retention of Your Information

We retain personal information as long as necessary to fulfill the purposes for which it was collected, including providing the Website, completing and supporting transactions, satisfying legal, accounting, or reporting requirements, establishing or defending legal claims, and preventing fraud. In determining retention periods we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes of processing and whether they can be achieved by other means, and applicable legal requirements. When personal information is no longer required, we delete or anonymize it or, if that is not possible, securely store it and cease using it until deletion is possible. De-identified information may be retained for longer periods.

Third-Party Websites

The Website may contain links to other websites, including social platforms, and may use third-party plug-ins. Interactions with third-party sites and plug-ins are governed by the privacy policies and terms of those third parties, not ours, and we are not responsible for their practices or content. We encourage you to read third-party privacy policies before disclosing personal information to them.

Your Regional Privacy Rights

If you are located in California, another US state with comprehensive privacy legislation, the European Economic Area, or the United Kingdom, you may have additional rights regarding your personal information, such as the rights to access, correct, delete, or restrict its use, and to opt out of certain sharing. This Policy may change over time, for example to comply with legal requirements or reflect changing business needs. The current version will always be posted on this page, and if a change is significant we will notify you in an appropriate additional way if and as required by law.
